Perkins permanently of the use and benefit of said property. (Ill. Rev. Stat. 1977, ch. 38, par. 16-1(a)(1).) Following a bench trial, the defendant was found guilty and was sentenced to serve a three-year term of imprisonment. On appeal by the defendant, the majority of the appellate court affirmed the defendant's conviction. (99 Ill. App.3d 810.) The defendant filed a petition for leave to appeal, which was granted. 73 Ill.2d R. 315(a).
